On the 28th of July 2004, one Abu (still at large) lured the deceased, a 3 years old from his parent’s house to an uncompleted building where the appellant herein was waiting with a knife.
It was further alleged that Abu held the deceased down whilst the appellant slashed his throat with the knife; thereby killing him. Thus, leaving the corpse in an uncompleted building where it was discovered.
Upon the arrest of the appellant, he made a confessional statement that Abu promised him a fee of N 60,000.00(Sixty Thousand Naira Only) if he assisted in the killing of the deceased.
At trial, the appellant testified in his own defence and called no witnesses.
Hence, he was charged for the offence of culpable homicide, convicted and sentenced to death.
The appellant’s appeal to the Court of Appeal was unsuccessful, hence a further appeal to the Supreme Court.
