Facts

The judgment of the Court of Appeal was delivered on the 15th of April 2010 and on the same day the appellant/applicant filed a Notice of Appeal containing two grounds of Appeal of Law. The appeal was entered in the Supreme Court on the 13th of May 2010. This process was filed by counsel for the appellant/applicant in the Court of Appeal, Chief Okpoko, SAN. Chief R. Akinjide SAN was briefed and he filed Notice of Appeal No.2 dated 25/6/10. He filed a Motion in the Court of Appeal seeking leave to appeal on grounds other than Law. The Court of Appeal heard and granted the application within 3 months of the judgment delivered on 15/4/10. It was granted on 8/7/10.
