Facts
In suit No. A/59/86 at the Aba High Court, the plaintiff’s claim against the defendant was for the sum of N500,000.00 (Five hundred thousand Naira) damages for breach of contract and negligence. Pleadings were ordered filed and exchanged. With the leave of the court below the plaintiff filed an amended statement of claim and a further amended statement of claim. The defendant also filed an amended statement of defence with the leave of the lower court. At the hearing of the matter before Mbachu J. one witness each testified for the plaintiff and for the defendant. At the conclusion of the case the learned trial Judge found for the plaintiff and awarded in the sum of N100,000.00 as general damages with N800.00 costs. Aggrieved and dissatisfied with the judgment of the trial court, the appellant appealed of the Court of Appeal.
