Facts

On the 28th of December, 2001 at about 3:00pm, the appellant herein and other persons still at large stormed the premises of Value Tech Company at Ijare, armed with guns and cutlasses. While the robbery was on going, two (2) female employees of the company scampered into the bush for safety from where they had a good view of the robbery operation.

The Appellant and his gang carted away with N 42,650 after killing the gateman and driver of the company.

Consequently, the appellant was recognized on sight and identified as one of the robbers. Hence, the appellant was charged on one count of armed robbery leading to his conviction and sentence to death.

Dissatisfied, the appellant without delay appealed to the Court of Appeal which affirmed the decision of the trial court and dismissed the appeal on lacking merit. Upon further dissatisfaction, the appellant appealed to the Supreme Court.
