Plaintiffs sued for declaration of title on a piece of land in Bendel State. Evidence showed that the plaintiffs’ farm on the land in dispute, have their shrines there and that the boundary (which was in dispute) was a moat and that the defendants owned no part of the land in dispute.
The court found for the plaintiffs and the defendants appealed to the Court of Appeal which set aside the trial Court’s decision and reversed its findings.
Plaintiffs appealed to the Supreme Court.
