The 1st - 3rd respondents as representatives of Oja Oshodi Communities Akure filed a suit against the 5th respondent seeking a declaration that the Oja Oshodi Street, Akure is a right of way and public highway.
The court ordered the parties to the suit to maintain the status quo on the land in dispute and also ordered an accelerated hearing of the suit.
Appellants then filed an application seeking an order for leave to represent the Akure Muslim Community in the suit; and for an order joining the Akure Muslim Community as defendant and counter-claimant in the suit.
After hearing appellants' application, the trial court granted the reliefs sought and also declared that the certificate of occupancy and related documents which were attached as exhibits to the appellants' affidavit in support of their motion were null and void; and expunged same from the records of the court.
The appellants were aggrieved with the additional orders and appealed to the Court of Appeal.
