The appellant lost to the 1st respondent at a local government election held in March, 1996 and then filed a petition at the Election Tribunal which was dismissed. A further appeal was done to the Local Government Election Appeal Tribunal which allowed the appeal and set aside the decision of the Election Tribunal.
1st respondent then went to the federal High Court (ex parte) asking for leave to apply for an order of certiorari to quash the proceedings and judgment of the Local Government Council Election Appeal Tribunal.
Appellant then filed an application at the Federal High Court seeking an order dismissing or striking out the action in limine on ground of lack of jurisdiction. The application was dismissed.
Dissatisfied with this decision the appellant appealed to the Court of Appeal.
