Facts

The appellant sued the 2 respondents before the High Court Benin claiming general damages of N1,000,000.00 for libel published in the Punch Newspaper on the 15th day July, 1987.

At trial appellant testified and tendered the Judgement of the Customary Court of Appeal as Exh A as well as a copy of the Newspaper report of the 1st respondent as Exh B. Respondent who called no witness tendered a certified true copy of the proceedings of the said Customary Court of Appeal through the appellant.

Trial Judge gave Judgement in favour of respondents an upheld the defence of privilege. Appellant dissatisfied, appealed.
