This is an appeal against a Judgment of Ohiwerei, J. of the former Bendel State High Court holden at Benin City in suit No. B/254/86 delivered on 19th July, 1988, wherein he dismissed plaintiff's claim for wrongful termination of appointment and rein-statement as a Civil Servant but granted Defendant's counter-claim for the sum of N22,739.49k being over payment of Salaries wrongly credited into plaintiff's Bank Account, while he was on study leave without pay in the United State with N250.00 costs against the plaintiff. The Plaintiff being dissatisfied with that Judgment has appealed this Court.
