This is an appeal against the Judgment of the Court of Appeal, Jos division delivered on the 9th day of December, 2016 which dismissed the appellant’s appeal and affirmed the conviction and sentence of the appellant.

This led to the charge of the appellant with culpable homicide punishable with death, contrary to section 221 of the Penal Code, Cap. 89, Laws of Northern Nigeria, 1963.
At the trial, the prosecution called four witnesses who testified as PWs 1-4 and tendered 3 exhibits including the knife used in stabbing the deceased while the appellant testified in his defence. At the conclusion of the trial, the learned trial Judge convicted the appellant and sentenced him to death.
Dissatisfied with the judgment of the trial court, the appellant’s appeal to the lower court was unsuccessful and dismissed, hence he further appealed to this honourable court.
