Facts

Suit Nos. PHC/9/70 and PHC/113/72 were consolidated by the agreement of both parties in this suit

The Respondents in this appeal were the Plaintiffs in Suit No. PHC/9/70 and Defendants in Suit No. PHC/113/72.

After the consolidation, the Plaintiffs in Suit No PHC/9/70 became Plaintiffs in the consolidated suit while the Plaintiffs in Suit No. PHC/113/72 became Defendants/Appellants.

The Respondents as Plaintiffs in Suit No.PHC/9/70 sued the Defendants claiming the following relief’s.

  • a.
    A declaration that the Plaintiffs are entitled to customary rights of occupancy of adjoining portions of land known as Nomabon Nuebente and Gboro, situate, lying and being at Barako village in Bori Local Government Area.
  • b.
    That the Respondent has been in constructive desertion for the past four years. In that ever since, the Respondent has denied conjugal rights to the petitioner.
  • c.
    That the Respondent has ever since aforesaid refused even to talk to the Petitioner and has completely abandoned all domestic responsibilities of a wife.
