Facts

Appellants had sought a declaration that the appointment of the 8th defendant as the Chief of Longuda was null and void; that it was made in breach of Longuda Native Law and Custom, and procedure of appointment and selection of the Chief of Longuda.

The trial Judge found for the defendants/respondents.

The Court of Appeal held that the findings of the trial court could not be interfered with as the learned Chief Judge’s findings of fact had already dealt with them.

The appellants appealed to the Supreme Court.
