Plaintiff/appellant had brought a civil action against the defendants/respondents for a declaration of title and an injunction. Defendants had a building on the disputed land.

Plaintiff/appellant brought an application (which was granted) for an order for the appointment of a receiver to manage and control the building on the disputed land and to collect all the rents and profits from the said premises pending the determination of the suit but the Court of Appeal set aside the order on appeal by the defendants/respondents. The plaintiff/appellant appealed to the Supreme Court against the decision of the Court of Appeal.
