The facts of this case briefly put are as follows: The appellant herein sued as plaintiff in the lower court and claimed from the defendant/respondent as follows:-

The sum of N250,000.00 representing damages suffered by the plaintiff for breach of contract consisting in the wrongful refusal of the defendant to allow the plaintiff on the balance of the overdraft facility granted to the plaintiff by the defendant by letter dated 31st August, 1987 and secured by deed of mortgage dated 10th September, 1987 and registered as No 72 at page 72 in volume 32 of the lands Registry of Ilorin.

ALTERNATIVELY the plaintiff claims the said sum as damages suffered by the plaintiff as a result of the negligence of the defendant in stopping the operation of the overdraft facility granted to the plaintiff and secured as stated under claim (i) above.

10% interest on the total amount awarded with effect from the date of judgment See pages 6-7 paragraph 29.
Pleadings were filed and both parties led evidence. At the end of evidence of the defence both counsel to the parties addressed the court. At the end of the trial the High Court found the defendant liable to the plaintiff and warded the sum of N11,500.00 as general damages with 10% interest on the amount to the plaintiff.
Dissatisfied with e award of only N11,500.00 as general damages, the plaintiff appealed to this court.
