Gubernatorial Elections were conducted all over the country on the 14th day of April 2007. In Edo State, the peoples Democratic Party [PDP] and Action Congress [AC] fielded Senator Prof. Oserheimen Osunbor and Comrade Adams Aliyu Oshiomole as their respective candidates, and the Independent National Electoral Commission [INEC] returned PDP's candidate, Senator Prof. Oserheimen Osunbor as the winner of the election. Dissatisfied with the results declared by INEC, Comrade Adams Oshiomole and Action Congress filed a petition of 69 paragraphs at the Edo State National Assembly, Governorship and Legislative Houses Election Petition Tribunal.
The appeal was consolidated against the finding of the Edo State National Assemble, Governorship and Legislative Houses Election Petition Tribunal, or the Tribunal. The election of Senator (Prof) O. Osunbor as the Governor of Edo State was nullified by reasons of corrupt practice and non-Compliance with the provisions of Electoral Act 2006. Comrade Adams Oshiomole was consequently declared the elected Governor, being the candidate who scored the highest number of valid votes Cast.
Dissatisfied with their finding, INEC and its officers appealed to the Court of Appeal. The people's Democratic party (PDP) as well as Senator (Prof) O. Osunbor, also filed their respective Notices of Appeal, against the finding of the Tribunal.
