On the 22nd of January 2009, the Appellant herein was arraigned in the High Court of Ozoro, Delta State on a six counts charge of conspiracy to commit Armend Robbery and Armed Robbery.
However, the Appellant pleaded not guilty to all the charges. At the conclusion of trial, he was discharged and acquitted in respect of counts II,III,IV and VI but was convicted on counts I and V (conspiracy to commit Armed Robbery and Armed Robbery).
The trial judge held that the prosecution proved its case beyond reasonable doubt.
The appellant appealed to the Court of Appeal which also dismissed the appeal and affirmed the decision of the lower court.
The lower courts place reliance on the oral evidence on the complainant and her extra judicial statement.
Dissatisfied, a further appeal was made to the Apex court.
