Facts

Respondents sued for a declaration of title to land, an order for payment of compensation receiver and a perpetual injunction against the defendants.

The trial judge held that the plaintiffs had failed to provide sufficient evidence to earn the declaration and injunction prayed for.

Plaintiffs appealed to the court of appeal who substituted its own and granted the declaration of title and in junction to the plaintiff.

Defendants appealed against this decision, to the Supreme Court.
