Facts

There was a dispute between the parties over three villages of Kabong, Tudun Wada and Dong. Two Districts in two Local Government Areas of Jos North and Jos South were each laying claim to the three wards or villages.

The Military Governor of the State constituted a commission of inquiry with terms of reference to submit report to him.

The Appellants who felt aggrieved by the exercise of the powers of the Governor, challenged it at the High Court of Plateau State and the trial High Court after hearing the parties, found for the Defendants/Respondents. The Plaintiffs/Appellants who were dissatisfied appealed to the Court of Appeal. The Court of Appeal dismissed the appeal.

Still dissatisfied the Appellants appealed to the Supreme Court.
