Appellants sued respondents in a Grade 'A' customary court, seeking a declaration of title to a piece of land, damages and an injunction.
Both sides tendered plans, some of which had been utilised in previous suits in which the respondents were parties and in which they had made admissions prejudicial to their interest in the present case. The trial court dismissed the claim and the ap¬pellants appealed to the High Court where the appeal was allowed.
The respondents then appealed to the Court of Appeal, which allowed their appeal and restored the trial court's judgment.
Thereupon the appellants appealed to the Supreme Court.
