Applicants brought an application asking the court of appeal to grant on order for extension of time to appeal: leave to appeal; extension of time to file notice of appeal.

Their application was supported by an affidavit in which a copy of the Kaduna State High court Judgement in suit No KDH/KAD/533/90 was attached.

The facts of the case were that applicant inherited a plot of land and an uncompleted building as part of her share of her deceased husband's estate as distributed by the upper Area court No 1, Zaria.

She then started clearing the plot and was subsequently served through her site workers a certificate of Judgement relating to the stated suit litigated between the 1st respondent herein on the one hand and the other respondents on the other.

Applicant did not become aware of the suit until she was served the Judgement certificate. When she became aware, she stopped development and brought their application.
