Facts

Plaintiffs sought a declaration that the defendant was not entitled to go back into occupation of certain lands in Lagos State leased under the State Lands Act and an injunction restraining the defendant from going into occupation of the land.

The matter revolved around the notice to the plaintiff to the effect that the Lagos State Government wanted to resume occupation of the land for a public purpose

The learned trial Judge gave judgment for the defendant. Plaintiff appealed to the Supreme Court.
