Facts

The Plaintiff invoked the original jurisdiction of the Supreme Court in order to claim some declaratory and injunctive reliefs against the Defendant. After the suit had been adjourned for judgment, the Supreme Court raised the issue of jurisdiction suo motu and invited Counsel to both parties to address the Court on whether the original jurisdiction of the Court had been properly invoked having regard to the nature of the dispute.

The Plaintiff argued in favour of the Court's original jurisdiction contending that the Nigerian Police Force whose conduct is being challenged is an Agency of the Federal High Court. The Defendant contended that the Court has no jurisdiction to entertain the suit.
